[p. 192] In the Name of God Amen I Timothy Duck of the Isle of Wight County am at this time weak and low of helth of body but in perfect sense and Memory and calling to mind the uncertainty of this life do think fit and proper to make and ordain this to be my last Will and Testament in Manner and form following, first it is my Will and desire that all my Just Debts and Funeral Expenses should be paid and satisfied and the Remainder of my Estate be given as Followeth

Item I give and bequeath unto my Son Joseph Duck, one Negro Boy named Tom and one feather Bed and Furniture and also one Cow and Calf and my new Gunn and two basins and two Dishes not [p.193] of the best nor worst of the Pewter and six plates to him and his Heirs forever—

Item I give and bequeath unto my Daughter Martha Johnson one Negro Girl called Kate, one Cow and Calf to her and her Heirs Forever.———

Item I give and bequeath unto my loving wife Sarah Duck the use and Labour of Three Negroes Called Seaser and Pegg and Sam During her life and after her decease I give the said Negroes to my four Children Jacob Duck, Nathan Duck, John Duck and Sarah Duck to be equally Divided with the increase of the said Negroes between the aforesaid Children to them and their Heirs forever———

Item I give and bequeath unto my son John Duck one Iron pott as I had at Isabel Johnson——

Item I give and bequeath unto my Beloved wife Sarah Duck the lands and plantation as I now live on during her natural life and after her decease I give the same unto my Son John Duck to him and his Heirs forever and if my Son John Duck should die without Heir it is my Will that my son Nathan Duck should have the said Land and plantation to him and his Heirs forever and in Case my Son Nathan Duck should without Heir it is my Will that my son Jacob Duck should have the said Land and Plantation to him and his Heirs forever.———

Item I leave all the Remainder part of my Estate to my loving wife Sarah Duck during her life and after her decease and after her decease I leave it to be equally divided between my four Children Jacob Duck, Nathan Duck, John Duck and Sarah Duck to them and their Heirs forever.———

Item I give and bequeath unto my Daughter Sarah Duck five yards of Holland as in the House and Nine yards of Cotton Cloth as is in the House. I also do Nominate [p.194] and appoint my loving wife Sarah Duck and my Son Joseph Duck my hole and Sole Executors of this my last Will and Testament Revoking Disannulling and Making Void all other former Wills and Testaments by me before made or caused to be made. As Witness my hand and Seal third Day of October One Thousand Seven Hundred and Seventy Two.———

At a Court held for Isle of Wight County the 7th Day of January 1773, This Will was Presented in Court by Sarah Duck and Joseph Duck the Executors therein named who made oath thereto according to Law and the same being Affirmed to by Jesse Watkins and Priscilla Jordan [as written in the will]. Sworn to by Obadiah Jordan the witnesses thereto and ordered to be recorded and on the motion of the said Executors who together with Michael Johnson and Jesse Watkins their Securitys entered into and Acknowledged their bond in the penalty of one Thousand pounds with condition as the Law directs Certificate is granted them for obtaining a probate thereof in Due Form.———
